SMS Terms and Conditions

Please carefully review the following Plan A SMS Terms and Conditions (“SMS Terms”). By checking the box to sign up for one or more text messaging programs, you expressly consent to receive non-marketing and marketing text messages from NEXT Life Sciences, Inc, dba Plan A (“Plan A”) and others texting on its behalf, including text messages made with an automatic telephone dialing system at the telephone number(s) that you provide. You accept and agree to be bound by the SMS Terms, our website Terms of Use and Privacy Notice , and all applicable laws and regulations.
You may opt-out of these communications at any time, as instructed below. Consent to receive marketing text messages is not required to purchase any goods or services.
1. Program Description. Plan A mobile alerts are marketing text messages that contain information about Plan A’s promotions or deals that may be of interest to you. Plan A and its service providers may use an autodialer to deliver Plan A text messages. Text messages are intended to provide you with information about Plan A’s products and services.
2. How to Opt-in. To opt-in to receive text messages from Plan A, please contact us at (209) 870-6398.
How to Opt-out. You can cancel the SMS service at any time. To opt out, reply STOP to a message or text STOP to the short code. After you send the SMS message STOP to Plan A, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from Plan A.
Pausing Messaging. You also have the ability to temporarily discontinue your participation in the text program by texting PAUSE to the short code.
Support/Help. If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at (209) 870-6398.
Access or Delivery to Mobile Network is Not Guaranteed. Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Plan A’s control, and Plan A is not responsible or liable for issues arising from them. Carriers are not liable for delayed or undelivered messages.
Supported Carriers. Supported carriers may change from time to time, but currently include AT&T, T-Mobile, Verizon Wireless, Sprint, Nextel, Boost, Alltel, US Cellular, and Cellular One, among others.
Rates. MESSAGE AND DATA RATES MAY APPLY FOR ANY MESSAGES SENT TO YOU FROM PLAN A AND TO PLAN A FROM YOU.
Message Frequency. Message frequency will vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Privacy. If you have any questions regarding privacy, please read our Privacy Notice.
Your Mobile Telephone Number. You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying Plan A immediately if you change your mobile telephone number. You agree to indemnify Plan A in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Plan A if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
Eligibility. To receive Plan A text messages, you must be a resident of the United States and 18 years of age or older. Plan A reserves the right to require you to prove that you are at least 18 years of age.
Changes to SMS Terms. Plan A may revise, modify, or amend these SMS Terms at any time. Any such revision, modification, or amendment shall take effect when it is posted to www.planaformen.com. You agree to review these SMS Terms periodically to ensure that you are aware of any changes. Your continued consent to receive Plan A text messages will indicate your acceptance of those changes.
Termination of SMS Messaging. Plan A may suspend or terminate your receipt of Plan A text messages if Plan A believes you are in breach of these SMS Terms. Your receipt of Plan A text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. Plan A reserves the right to modify or discontinue, temporarily or permanently, all or any part of Plan A text messages, with or without notice.
15. PLAN A’S SMS MARKETING MESSAGES ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, NEXT HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
